Can I use forensic animation to help me with case evaluation? What are the benefits of using forensic animation for deposition? What are the benefits of using forensic animation in mediation? What are the benefits of using forensic animation for trial? How accurate is a forensic animation? What is a model forensic animation? What is a demonstration forensic animation? What is a re-creation (or reconstruction) forensic animation? What is a simulation forensic animation? What types of cases are forensic animations good for? How long should a forensic animation be?
Can
I use forensic animation to help me determine the merits of the
case?
Yes, you can! The process of
building an animation will assure clarification of the facts. It
will soon become apparent if it is a strong or a weak case. Any
"holes" (gaps in what happened or who was where/when,
etc.) become quite evident.
What are the
benefits of using forensic animation for deposition?
The development of a forensic animation prior to
deposition will show where information and collaboration is
needed. A forensic animation helps focus the questions, eliciting
more complete information during the deposition. Show the
animation during Q & A and ask, "Is this what
happened?"
What are the
benefits of using forensic animation in mediation?
Forensic animations require rigorous attention to
detail. This means the expert and attorney will be totally
prepared; you will know
that you are prepared; you will
show it. The opposition will know they are in trouble. Please
note: Animations for deposition and mediation do not need to be
highly realistic to convince the other side you are holding all
the Aces.
What are the
benefits of using forensic animation for trial?
When appropriate for trial, a forensic animation
will make the facts clear to the jury better than other type of
demonstrative evidence.
Animations provide continuity and smooth transitions from exhibit to exhibit.
Animations add reinforcement to the experts testimony.
Animations are mental adhesive people remember an animation.
Animations are very compelling.
The more realistic the demonstrative evidence
the more people relate to it.
How accurate
is a forensic animation?
It depends on the information supplied to the animator.
We build everything to scale and make every effort to create an
accurate animation. We work directly with the expert witness.
Some of the things we do to insure accuracy:
use aerial and satellite photos and maps
use surveys
dis-assemble and measure exemplars
make site visits to take photographs and measurements
use on-screen virtual instrumentation to display a real-time
clock, speed, and distance.
Following the guidelines of the "same or
substantially similar" rule - an experienced animator will
make sure that models are appropriate for the animation.
Tolerances will vary depending on the scene, message, etc. If the
tolerances are too loose, it looks sloppy and is a potential
opening for opposing counsel (avoid scale-less modeler, avoid
CAD-phobics, avoid animators that cant convert units).
Tolerances that are too tight is very costly and does not show
(avoid ultra type-A personalities that use .001" tolerances
on everything, avoid hyper-realism).
What is a model
forensic animation?
All animations start with models of objects and or
people. The models must be accurate and made to scale. Model
animations are entered as demonstrative evidence.
What is a
demonstration forensic animation?
A demonstration animation shows how something
works (like what happens when you push the button down on the
toaster). Demonstration animations are usually uncontested. This
type of animation is entered as demonstrative evidence.
What is a
re-creation (or reconstruction) forensic animation?
A re-creation animation is an opine of an event.
The script is known ahead of time - there are no surprises. This
type of animation is entered as demonstrative evidence.
What is a simulation
forensic animation?
Simulation animations analogize or prove something
and are calculated by the computer. It is the basis for or
reinforces the experts opine. Simulation animations can be
admitted as either scientific evidence or demonstrative evidence.
What types of
cases are forensic animations good for?
Civil and criminal cases. Virtually
any type of case could benefit from a forensic animation,
including:
Accident Reconstruction
Patent Infringement
Environmental Law
Product Liability
Personal Injury & Torts
Crime Reenactment
Medical Malpractice
How long
should a forensic animation be?
An animation should be no longer
than is necessary to explain the key points. Movies belong in
Hollywood. Our goal is to assist you in presenting your case
ethically, with respect for judicial economy of time.
